(d) If the waste is determined to be hazardous, the generator shall refer to chapters 14, 15, <br /> 18, and 23 of this division for possible exclusions or restrictions pertaining to <br /> management of the specific waste. <br /> 4 Mop water contaminated with antifreeze and sanding waste from body shop have <br /> not been characterized for hazardous properties and not managed as hazardous waste. <br /> Title 22, CCR 66265.31 Facility not maintained to minimize the release of hazardous <br /> waste. Facilities shall be maintained and operated to minimize the possibility of a fire, <br /> explosion, or any unplanned sudden or non-sudden release of hazardous waste or <br /> hazardous waste constituents to air, soil, or surface water which could threaten human <br /> health or the environment. <br /> 4 During the April 7, 2006 inspection, an unattended transmission was leaking <br /> transmission fluid onto the ground, spent absorbent was found left on the ground <br /> around the used oil tank at the service area, and all the drains leading to the oil water <br /> separator appeared to be plugged and full. <br /> HSC 25201 (a) Stored hazardous waste on site longer than 90 days without a permit <br /> or authorization. <br /> (a) Except as provided in subdivisions (c) and (d), no owner or operator of a storage <br /> facility, treatment facility, transfer facility, resource recovery facility, or disposal site <br /> shall accept, treat, store, or dispose of a hazardous waste at the facility, area, or site, <br /> unless the owner or operator holds a hazardous waste facilities permit or other grant of <br /> authorization from the department to use and operate the facility, area, or site, or the <br /> owner or operator is operating under a permit-by-rule pursuant to the department's <br /> regulations, or a grant of conditional authorization or conditional exemption pursuant to <br /> this chapter. <br /> (b) Except as necessary to comply with Section 25159.18, any person planning to <br /> construct a new hazardous waste facility or a new hazardous waste management unit, <br /> which would manage RCRA hazardous waste, shall obtain a hazardous waste facilities <br /> permit or a permit amendment from the department prior to commencing construction. <br /> (c) A hazardous waste facilities permit is not required for a recycle-only household <br /> hazardous waste collection facility operated in accordance with subdivision(b) of Section <br /> 25218.8. <br /> (d) A hazardous waste facilities permit is not required for a facility that meets the <br /> requirements of Section 13263.2 of the Water Code. <br /> 4 During the April 7, 2006 inspection, a 55-gallon drum containing oily debris and a <br /> SS gallon drum containing flammable waste were found with accumulation start dates <br /> of 01127/05 and 12108/05, respectively. <br /> Title 22,CCR 66262.34 Failed to properly label containers of hazardous waste. <br /> (a) Except as provided in subsections (c) and (d) of this section and section 66262.35, a <br /> generator may accumulate hazardous waste on-site for 90 days or less without a permit <br /> or grant of interim status,provided that: <br /> (1)(A) the waste is placed in containers and the generator complies with the applicable <br /> requirements of articles 9, 27, 28 and 28.5 of chapter 15 of this division, or the <br /> waste is placed in tanks and the generator complies with articles 10, 27, 28, and <br /> 6 <br />
