The Atchison, Topeka and Santa Fe Railway Company <br /> ("ATSF") and Claude C. Wood Company, General Contractors ("Wood") <br /> enter into this Contract under the terms and conditions set forth <br /> below: <br /> <U) WHEREAS, ATSF desires the removal and cleanup of all <br /> 0-)dss from the bridge 1134.8 renewal project between old River and <br /> lli a River at its Station of Orwood, California. <br /> 211 z tZ WHEREAS, Wood has the ability to perform such removal and <br /> Y.. Q <br /> C1 up in accordance with applicable laws, ordinances and <br /> ) r ations. <br /> o z <br /> WHEREAS, ATSF and Wood are parties to a contract dated <br /> January 1, 1989, filed in ATSF's records as Secretary's Contract <br /> No. 178186. <br /> In consideration of the mutual promises and conditions set forth <br /> below the parties agree as follows: <br /> 1. Scope of Work. <br /> Wood shall remove and dispose of all debris from the <br /> bridge 1134.8 renewal project between old River and Middle River at <br /> ATSF's Station of Orwood. Such removal shall be accomplished by <br /> Wood loading such debris onto barges, moving such barges to dry <br /> land where the debris shall be removed from the barges and placed <br /> onto trucks for transport to and disposal at an appropriate <br /> disposal facility. Care shall be taken to minimize, to the fullest <br /> extent possible, any disturbance to the plant or animal life <br /> surrounding bridge 1134.8. <br /> 2. Compensation. <br /> Compensation for the work covered by this Contract shall <br /> be in the amount of $291,798.00, which amount includes $86,000.00 <br /> for fees associated with the disposal of the debris.- <br /> 3. Time of Completion. <br /> All work encompassed by this Contract shall be completed <br /> within 10 Working Days of November 9 , 1992. <br /> 4.
