The Atchison, Topeka and Santa Fe Railway Company -r <br /> 740 Last Carnegie Drive <br /> San Bernardino, CA 92408-3571 <br /> April 13, 1992 <br /> File: 05002484-26 <br /> California Fish and Game Commission <br /> 1701 Nimbus Road <br /> Rancho Cordova, CA 95670 <br /> Dear Sirs; <br /> This letter has reference to the ATS@SF Railwny Bridge 1134.3 near Onvood, California and <br /> numerous conversations between various employees of the Santa Fe Railway and Mr. Art <br /> Ramirez of your office. <br /> Mr. Ramirez has made repeated phone calls and threats of action that will be taken if the <br /> site in question is not "cleaned up". Mr. Jay Craft, General Supervisor Structures, has <br /> assured Mr. Ramirez that we will make every effort to comply with applicable rules and <br /> regulations. <br /> On March 13, 1992 Mr. Ramirez requested a "Material Safety Data Sheet" on the timber <br /> being removed from the bridge. While it is impossible to obtain a M.S.D.S. on timber that <br /> was treated .67 years ago, a current sheet was supplied to Mr. Ramirez for treatment <br /> currently in use. It should be noted, however, that time and the elements combine to break <br /> down and dilute the material, resulting in timber that has only a trace of the original <br /> treatment. <br /> On Friday, April 3, Mr. Ramirez made repeated phone calls to Santa Fe personnel again <br /> threatening action. Mr. Craft contacted Mr. Ramirez and requested that a meeting take <br /> place at the site in question to resolve the alleged problem. Mr. Ramirez agreed to meet <br /> Mr. Craft on Friday, April 10 Gr Saturday, April : 1. 1:1r. Craft traveled from San <br /> Bernardino to Orwood for this meeting and stayed at the bridge from 3:00 a.m. until 4:00 <br /> p.m. both days. Mr. Ramirez did not keep his appointment or call Mr. Craft's office. Mr. <br /> Ramirez had also agreed to leave a message on Mr. Craft's phone mail if he would not be <br /> able to keep his appointment. <br /> Santa Fe has done every thing that might be reasonably expected to resolve the concerns <br /> of your office.
