1 16 hours credit for time served, toward the first 100 hours of <br /> 2 community service to be performed. Defendant Art Smith shall <br /> 3 receive eight (8) hours credit for time served, toward the first <br /> 4 100 hours of community service. The hours of community service <br /> 5 during the second and third year of probation may be reduced or <br /> 6 eliminated if, during the first year of probation, the <br /> 7 individual defendants have substantially complied with all <br /> 8 conditions of probation, and provided that defendant corporation <br /> .9 undertakes a program of community service satisfactory to the <br /> 10 District Attorney, or if the District Attorney is otherwise <br /> 11 satisfied that there is good cause to reduce or eliminate <br /> 12 community service during the second and/or third year of <br /> 13 probation. <br /> 14 4 . The individual defendants shall be placed on informal <br /> 15 <br /> probation for three years. <br /> 16 5 . All the defendants, including the corporation, shall <br /> 17 consent to search of the defendant corporation's premises by any <br /> 18 environmental regulating agency regarding safety, hazardous <br /> 19 materials and hazardous waste. <br /> 20 6 . Defendant corporation shall plead no contest to Counts <br /> 21 1 through 6 . <br /> 22 7 . The defendant corporation shall pay for two scheduled <br /> 23 and three unscheduled inspections per year of the defendant <br /> 24 corporation's premises by the San Joaquin County Department of <br /> 25 <br /> Environmental Health, at the rate of $78 . 00 per hour, up to a <br /> 26 maximum of five hours per inspection. <br /> 27 <br /> 8 .
