1 <br /> (a) to the District Attorney: $5 , 851 . 21; <br /> 2 (b) to the San Joaquin County Department of <br /> 3 Environmental Health: $15 , 898 . 00; <br /> 4 (c) to the Department of Toxic Substances: a sum not <br /> 5 to exceed $12 , 000 . 00; the District Attorney shall provide <br /> 8 evidence of the final amount expended by the Department of Toxic <br /> 7 Substances to the attorney for the defendant corporation, as <br /> 8 proof of the final amount; defendant corporation does not waive <br /> "9 its right to a restitution hearing on the amount of <br /> 10 reimbursement to the Department of Toxic Substances. <br /> 11 (d) Payment shall be made as follows: Interest shall <br /> 12 be paid at the rate of 12% per annum. The first interest <br /> 13 payment shall be paid on or before November 24 , 1994 . <br /> 14 Thereafter, interest shall be <br /> paid yearly; the principal shall <br /> 15 beaid within 30 days of the first calender <br /> p y year when the <br /> 16 <br /> defendant corporation gross receipts exceed $1, 750, 000. 00. <br /> 17 9 . Delinquent taxes to the Franchise Tax Board and the <br /> 18 Internal Revenue Service shall be paid in accord with the <br /> 19 written agreements between the Franchise Tax Board, the Internal <br /> 20 Revenue Service and defendant corporation. <br /> 21 <br /> 10 . The defendant corporation shall pay District Attorney <br /> 22 costs in Case No. SM231300 in the sum of <br /> $10, 000 plus interest <br /> 23 at the rate of 12% per annum from June 30, 1993 ; said costs <br /> 24 shall beaid as follows : the first interest <br /> p payment shall be <br /> 25 paid on or before November 24 , 1994 ; thereafter, interest shall <br /> 26 <br /> be paid yearly; the $10, 000 principal shall be paid within 30 <br /> 27 days of the first calendar <br /> y year when the defendant corporation's <br /> 28 <br /> gross receipts exceed $1, 750 , 000. <br /> 4 . <br />
