The following information will explain <br /> what services are available to assist you. A Deputy District Attorney will handle the prosecution of the case you are involved in <br /> and represent your interests. It is very important to keep the District Attorney's Office informed of your current address and <br /> telephone number so we can contact you about your case. <br /> SUBPOENA <br /> A subpoena is a court order commanding you to be present at the time and place stated. You may receive your subpoena by <br /> mail or in person. After receipt of the subpoena, contact the District Attorney's Office immediately to let them know you have <br /> received your subpoena. Be sure to bring the subpoena to court. <br /> WHAT HAPPENS IF THE CASE IS CONTINUED? <br /> Many times, for various reasons, a case will be continued to a later time.We will make every effort to contact you and advise you <br /> that you need not appear on that date indicated on your subpoena. The Penal Code provides that, in circumstances such as these, <br /> when the proceedings have been continued, the District Attorney's Office need not issue another subpoena. If you are contacted <br /> by a representative of the Victim/Witness Office of the District Attorney's Office and advised that the date to appear has been changed, <br /> you will be expected to appear on that date and time. It is as binding as the original subpoena and will carry the same consequences <br /> if you fail to appear. <br /> IF YOU ARE THE VICTIM <br /> If you have lost wages or incurred medical bills as a direct result of the crime,you may be eligible for reimbursement of these expenses <br /> through a program called Victim of Violent Crime Indemnification. The Victim/Witness Assistance Program staff will assist you in <br /> filing your claim. <br /> SECTION 1331 PENAL CODE - DISOBEDIENCE TO SUBPOENA, HOW PUNISHED: <br /> Disobedience to subpoena,or a refusal to be sworn or to testify as a witness may be punished by the court or magistrate as a contempt. <br /> FOR YOUR CONVENIENCE: <br /> You may, in lieu of a court appearance at the time specked in the subpoena, agree with the party who issued the subpoena to <br /> appear at another time. Remember, failure to appear pursuant to such an agreement as well as failure to comply with a subpoena <br /> may be punished by the Court as contempt. (Sections 1331, 1331.5 Penal Code.) <br /> "As a witness, you may be entitled to witness fees and/or mileage for your appearance in Court. Such fees, however, are in the <br /> discretion of the Court. The policy of the Court is not to pay witness fees except in hardship situations, or where travel for long <br /> distance is required.
