I doing business in the State of California, in the course of.defendant's TOTAL CHEMICAL NEEDS <br /> • 2 activities, are pursuant to Health and Safety Code §25100 et seq. hereby permanently enjoined from: <br /> 3 a. Violation of H&S Code §25189.5(b)• <br /> 4 b. Violation of H&S Code §25189,5(d). <br /> 5 4. Defendants with actual or constructive knowledge of this injunction, only in so far as they are doin <br /> 6 business in the State of California, in the course of defendant's TOTAL CHEMICAL NEEDS activities, are <br /> 7 pursuant to Health and Safety Code §2550.0 et seq. hereby permanently enjoined from: <br /> 8 a. Violation of Health and Safety Code §25504(c); <br /> 9 b. Violation of Health and Safety Code §25503.5; <br /> 10 c. Violation of Health and Safety Code §25504(b). <br /> 11 5. Defendants with actual or constructive knowledge of this injunction, only in so far as they are <br /> 12 doing business in the State of California, in the course of defendant's TOTAL CHEMICAL NEEDS <br /> 13 activities, are pursuant to Business and Professions Code§ 17204 hereby permanently enjoined from: <br /> 14 a. Violation of Health and Safety Code §25100 et seq., as described in paragraph 3 -3b <br /> • 15 above; <br /> 16 b. Violation of Health and Safety Code §25500 et seq., as described in paragraph 4 -4c <br /> 17 above; <br /> 18 c. Violation of the California Fire Code, Article 79, as it relates to hazardous waste and <br /> 19 hazardous materials; <br /> 20 d. Violation of the California Fire Code,Article 80, as it relates to hazardous waste and <br /> 21 hazardous materials, <br /> 22 6. Defendant shall pay to plaintiff the sum of NINETEEN THOUSAND EIGHT HUNDRED <br /> 23 SEVENTY-FIVE DOLLARS ($19,875.00), as and for civil penalties, pursuant to Business and Professions <br /> 24 Code §17200 et seq.. Said payments shall be made payable to the TREASURER OF SAN JOAQUIN <br /> 25 COUNTY and delivered to the San Joaquin County Office of the District Attorney, Environmental <br /> 26 Prosecutions Unit,by the following dates: <br /> 27 $6,625.00, on or before July 1, 2008 <br /> 28 $6,625.00, on or before July 1, 2009 <br /> • 2 <br />
