San <br /> Joaquin County Health made the referral because Universal Rundle <br /> stores waste acetone in an 8 , 000 gallon underground tank. On <br /> April 16, 1987 , you submitted information to DHS that indicates <br /> that you may be exempt from permitting requirements. This <br /> information includes: <br /> 1. Manifests from the last five pick-ups, which demonstrate <br /> that the waste is picked up approximately every 90 days. <br /> 2 . The manifests also demonstrate that no more than 4 , 000 <br /> gallons are picked up at any one time. You have <br /> represented to us that each manifested load is the result of <br /> complete evacuation of the tank. <br /> 3 . Romic Chemical recycles Universal Rundle's acetone. <br /> Based on this information, the Department hereby notifies you <br /> that your facility is not regulated as a storage facility under <br /> the State law and regulations. Section 25123 . 3 , Chapter 6. 5 of <br /> the California Health and Safety Code defines "Storage Facility" <br /> as a facility meeting the following requirements: <br /> 1. Hazardous waste contained on-site for periods greater than <br /> 90 days, or <br /> 2 . The hazardous waste is contained in a tank for any period of <br /> time and the quantities of the hazardous waste exceed 5, 000 <br /> gallons or 45, 000 pounds, whichever is greater. <br /> Since your facility does not appear to meet this definition of <br /> "Storage Facility" , your facility is exempt from the Hazardous <br /> Waste Facility permit requirements of DHS.
