The material must be returned as a <br /> substitute for raw material feedstock, and the process must use raw <br /> materials as principle feedstocks. <br /> 261.3- Definition of Hazardous Waste <br /> (a) A solid waste, as defined in 261.2, is a hazardous waste if: <br /> (1) it is not excluded from regulation as a hazardous waste <br /> under 261.4 (b); and <br /> (2) it meets any of the following criteria <br /> (i) it exhibits any of the characteristics of <br /> hazardous waste identified in Subpart C <br /> (ii) it is listed in Subpart D and has not been <br /> excluded per 260.20 and 260.22 <br /> (iii) it is a mixture of a solid waste and a hazardous waste listed in <br /> Subpart D solely because it exhibits one or more characteristic, <br /> unless the mixture no longer exhibits that characteristic <br /> (iv) it is a mixture of solid waste and a hazardous <br /> waste listed in Subpart D and has not been excluded. <br /> 261.4- Exclusions <br /> 261.6- Requirements for Recyclable Materials <br /> (a) (1) Hazardous wastes that are recycled are subject to the requirements for <br /> generators, transporters and storage facilities of Paragraphs (b) and (c) of this <br /> section. Hazardous wastes that are recycled will be known as "recyclable materials". <br /> 261.7 - Residues of Hazardous Wastes in Empty Containers <br /> (b) (1) A container or inner liner removed from a container that has held any hazardous <br /> waste, except a waste that is a compressed gas or that is identified as <br /> an acute hazardous waste as defined in 261.31, 261.32 or 261.33 (e) of this chapter <br /> is empty if: <br /> (i) all wastes have been removed using practices commonly <br /> employed to remove materials from that type container and <br /> (ii) no more than 2.5 cm (1 inch) of residue remain on the bottom <br /> of the container or inner liner or <br /> (iii) (a) no more than 3% by weight of the total <br /> capacity of the container remains if the container is <br /> <= 110 gallons or <br />
