STOCKTON December 25 2014 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS 11,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> 608 CCR 66266.130 Failed to properly manage used oil and fuel filters. <br /> 1) Bills of lading for the recycling of used oil filters for the last three years were not found on site. A copy of each bill of <br /> lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading for used oil filters for <br /> the last three years, maintain them on site, and submit copies to the EHD. <br /> 2) One green 55-gallon container of mixed oil filters and other items was observed inside the large metal storage <br /> container had an accumulation start date of 8-9-13 and labeled "Used-Drained Oil Filters".Oil soaked rags,absorbent <br /> pads, rubber gloves and poliethylene tubbing were all commingled with oil filters inside this green drum. <br /> 3) Two fuel filters, one red and one yellow,were stored on top of the lid of the 5-gallon container located in the <br /> hazardous waste storage area. Used oil filters shall be drained of free-Flowing oil, stored in a closed, rainproof <br /> container, labeled as "drained used oil filters,"and marked with an accumulation start date. <br /> Immediately containerize all filters, segregate filters from other hazardous waste, mark the storage containers as <br /> appropriate and ensure that all used oil filters are managed in this way. Since it could not be determined how long <br /> these fuel filters have been onsite, dispose of them as appropriate and provide proof of correction to the EHD. This is a <br /> Class II violation. <br /> Overall Inspection Comments: <br /> Onsite in response to a complaint. This facility was found to be be generating hazardous waste, and as such, a <br /> routine hazardous waste inspection was conducted on December 26, 2014. A checklist of findings was left onsite <br /> at the time of inspection and a complete report was mailed to the facility on January 20, 2015. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation withing 30 days of receipt of <br /> the final report. <br /> Consent to perform the inspection, take photos and collect samples was given by Mr. Carlos Abarca. The <br /> inspection was conducted by Elena Manzo and Aris Veloso of the Environmental Health Department (EHD).The <br /> inspectors were accompanied by Carlos Abarca; Jim Clare, the facility owner, had also accompanied the <br /> inspectors during the first part of the inspection, but had to leave (before the end of the inspection) due to a <br /> personal emergency. <br /> Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information <br /> online to the California Environmental Reporting System (CERS) at hftp://cers.calepa,ca.gov.
