Minor Violations: 7, 60, 61 <br /> # 7. Metal fines generated from the equipment that grinds metal parts. Some are being thrown away <br /> without first determining particle size or hazardous properties. Any person who generates a waste shall <br /> determine if the waste is a HW. Immediately cease the current disposal practice, make a HW <br /> determination for the fine metal powder, and manage it according the Title 22 HW regulations. Particles <br /> 100 microns or smaller must be handled as HW if the metal is determined to be a HW. Submit a <br /> statement and supporting documentation explaining how this waste was managed by 10/25/10. <br /> # 60, 61. Manifest numbers: 000123120JJK (shipped 07/12/2007), 005920245JJK (shipped 11/05/2009) <br /> and 001983327SKS (shipped 12/09/2009) were not found on site. HW generators shall retain copies of <br /> all manifests for three years or until a copy signed off by the destination facility is received. The signed <br /> off copy shall be retained and made readily available for review for three years. If the generator did not <br /> receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to <br /> which the generator's waste was submitted, within 35 days of the date the waste was accepted by the <br /> initial transporter, the generator shall contact the transporter and/ or owner/operator of the designated <br /> facility to determine the status of the hazardous waste. Immediately locate a copy of the missing <br /> manifests or prepare a written statement how facility is trying to track the missing manifest. By <br /> 10/25/2010, submit a copy of the signed manifest to SJC EHD. <br /> Submit to SJC EHD within 30 days (10/25/2010)- <br /> 1. one copy of the completed "Return to Compliance Certification" form <br /> 2. a written corrective action statement for the above violations <br /> Notes: <br /> # 23. Two 55 gallon drums containing drained used oil filters, one located inside and the other outside <br /> of the oil storage room, lacked an initial start accumulation date. Corrected onsite. Labeled dates: <br /> 10/2009, 01/2010. Reminder: Storage of drained used oil filters can remain onsite for up to 1 year. <br /> - Universal Waste (UW) batteries has an initial start accumulation date of 10/2009.
