Stockton Street, Lodi CA <br /> 2/26/04, 3/1/04 <br /> according to California Code of Regulation (CCR) 66260.10 which <br /> states "Scrap metal" (b) excludes all ofthe following. (5) any metal <br /> contaminated with an oil that is a hazardous waste and that is free <br /> flowing. <br /> Class II Violations <br /> Many of the following violations are repeat violations discovered from previous <br /> inspections. <br /> 10. Failed to determine if a waste is hazardous waste. Floor sweep around the laser <br /> cutter is being disposed as solid waste. Two overfilled drums of burned paint ash <br /> accumulate without any form of secondary containment. Metal grindings from <br /> the machine shop are being transported off site for recycling. These three waste <br /> streams were sampled and sent out for hazardous waste analysis by <br /> Environmental Health Department (EHD). The STLC results were not available <br /> for the wheelabrator waste. Analyze this waste stream and the "caked" metals in <br /> the dumpster in the south yard for hazardous waste characteristics and submit <br /> results to this office. Until the results from the analysis show these waste are <br /> non-hazardous, immediately handle them in accordance with Title 22, Hazardous <br /> Waste regulations. <br /> 12. Facility not maintained to minimize the release of a hazardous waste. Plasma fine <br /> waste was observed on the ground in the area it was being generated. Cutting <br /> fluid was also observed streaming out towards a storm drain in the south side of <br /> the property(from the recycling bins) and outside the storage tent on the west side <br /> of the property. Addison Tube bender was observed to be leaking hydraulic oil. <br /> Take proper precautions to prevent such releases immediately. <br /> 15. Spill control equipment,and/or decontamination equipment not provided. Eye <br /> washes were not available or not working adequately in areas where hazardous <br /> wastes are being generated or stored. Provide proper decontamination equipment <br /> in these areas immediately. <br /> 30. Failed to keep a copy of the Consolidated Manifest for 3 years. Due to the permit <br /> status of the facility, a consolidated manifest cannot by used by the facility. The <br /> consolidated manifests reviewed lacked a contact person and proper shipping <br /> name including hazard class. This is a Class II violation. Immediately stop using <br /> a consolidated manifest for any waste at this facility. <br /> 45. Contingency plan incomplete. The contingency plan presented at the time of the <br /> inspection was determined to be incomplete. A section of Title 22 outlining the <br /> requirements of a hazardous waste contingency plan has been provided. Update <br /> the current contingency plan so that the requirements of the section have been <br /> satisfied. Submit a copy of the updated contingency plan to this office by 4/1/04. <br /> EHS Initialed by Date <br />
