June 15,2007
To: Toua Yang
San Joaquin Env. Health
From: Dan MclLrath
Valley Underground Tank
D./O. For Orlandos Market
18754 E. Highway 26
Linden, Ca. 95236
Toua,
I hate to admit it but I have to take some of the blame for this being late and try to explain
why and how. As far as it being late I did tell them that I would help with what I could
and get it turned into you, since they were in the middle of who was running the store,
who was responsible for what and so forth. I hope I went about this right and if not let me
know and I will take care of it one way or another. I am going to start at the top of your
inspection and work my way down, the sad part is I know I had this done within the time
limit and really thought I got it to your office, but when they said they received a call for
this I could not even find their copies and had to start from scratch again.
#4 the Letter of financial responsibility, I had the new "renters" do the first time and then
when I went back to get redone, I was informed that they felt that they were not
responsible for it as they are just leasing the business and not the land or tank owners so I
had to track down Orlandos to get them to fill it out.
#7,#22 & # 23, The alarm on # 7/8 disp. Pan Feb. 17,2007, somehow I overlooked this
and my only explanation is that, to this day I do not remember them telling me there was
an alarm, I don't remember resetting anything and I do not recall calling anyone for a
repair to this pan, I know I did not remove any water or fuel from any of their disp. Pans
since I have been their D./O. the only thing I can remember is that I have on occasion
lifted up on several of the sensors when I thought they did not look as though they were in
the correct spot, in the lowest point available in the pan, I don't know if maybe I set it off
on accident and that's why I overlooked it, I know that's no excuse, but I promise you I
will slow down a little during my inspections, especially reviewing the alarm logs, I am
sorry but that is the only thing I can think of that happened, and I don't think that are
smart enough to remove any fluid that might have been there, even if there was some in a
disp. Pan.
#21 the liquid that was found in the 87 and 91 sumps the day of the monitoring
certification, I was under the assumption that sumps did not have to be visually inspected
unless there has been an alarm, I know that Afford a Test removed the fluid that day and I
was not present at the time, but I can only think that it was possibly rain water from the
winter months and had not hit the alarm, I am going to make a practice of lifting the sump
covers at least two to three times a year regardless of alarms and maybe ever month
during the winter months to watch closer for water seeping in or to make sure that a
customer is not moving things around, as I have heard of some doing that, yet I don't
think any of my customers have, but I would not put anything past some of these guys.
