The notice <br /> shall describe the exact vertical and areal location of the closed <br /> underground storage tank, the hazardous substances it contained, and <br /> the closure method. <br /> (d) The owner of an underground storage tank being closed pursuant to <br /> this section shall demonstrate to the staisfaction of the local agency <br /> that no unauthorized release has occurred. This demonstration can be <br /> based on the ongoing leak detection monitoring, ground <br /> monitoring, or soils water closure activities. sampling performed during or immediately after <br /> If feasible, soil samples shall be taken and analyzed according to <br /> the following; <br /> (I ) If the underground storage tank or any portion thereof is <br /> removed, then soil samples from the soils immediately beneath the <br /> removed portions shall be taken. A separate sample shall be taken for <br /> every 200 square-feet for underground storage tanks or every 20 <br /> lineal-feet of trench for piping, at a minimum. <br /> (2) If the underground storage tank or any portion thereof is not <br /> removed, soils sampling pursuant to Section 2645 of Article 4 of this <br /> subchapter shall be implemented, if feasible. <br /> (3) Soils shall be analyzed for all constituents of the previously <br /> stored hazardous substances and their breakdown or transformation <br /> products. <br /> 67220 NOTICE IN DEED TO PROPERTY: <br /> (a) The owner of the property on which a disposal facility is located <br /> shall record, in accordance with State law, a notation on the deed to <br /> the facility property, or on some other instrument which is normally <br /> examined during title search, that will , in perpetuity, notify any <br /> potential purchaser of the property that: <br /> (1 ) The land has been used to manage hazardous waste <br /> (2) Its use is restricted under Section 67217(c) . <br /> (3)For permitted facilities the survey plat and record of the type, <br /> location and quantity of hazardous wastes disposed of within each cell <br /> or area of the facility required in Section 67219 have been filed with <br /> the local zoning authority or the authority with jurisdiction over <br /> local land use and with the Department. <br /> (b) If at any time the owner or operator or any subsequent owner of <br /> the land upon which a hazardous waste facility was located removes the <br /> waste and waste residues, the liner, if any, and all contaminated <br /> underlying and surrounding soil to the satisfaction of the Department, <br /> he may remove the notation on the deed to the facility property or <br /> other instrument normally examined during title search, or he may add <br /> a notation to the deed or instrument indicating the removal of the <br /> waste. <br /> NOTE: Authority cited: Section 203, Health and Safety Code.
