FINAL EXECUTION COPY <br /> violations of the Operation Plan, the ISD, any Hazardous <br /> Waste Facility Permit (Permit) , the Act, or orders or regula- <br /> tions adopted thereunder, during the term of this Agreement <br /> and Order, so long as the Company remains in compliance with <br /> this Agreement and Order, the Operation Plan, the ISD, and/or <br /> Permit, as applicable. <br /> With regard to any water quality degradation that <br /> may have occurred as a result of the matters alleged in <br /> Sections VII and VIII of that certain Settlement Agreement <br /> (Settlement Agreement) and Director' s Order Pursuant to <br /> Settlement (Settlement Agreement Order) entered into by the <br /> Parties on the date of this Agreement and Order, the Board <br /> covenants not to seek civil monetary remedies or take any <br /> other administrative, criminal, or judicial enforcement <br /> action against the Company during the development, review, <br /> and implementation of the State-approved Soils Assessment, <br /> Groundwater Assessment, and Off-Site Monitoring Plans and <br /> during the development, review, and approval of the Pollution <br /> Control and Mitigation Plan, all in compliance with Sec- <br /> tion XVI herein, so long as the Company remains in compliance <br /> with this Agreement and Order, and its waste discharge <br /> requirements. <br /> The agreements contained in this Agreement and <br /> Order by the Company and the Board to one another, and by the <br /> Board and the Department to one another, are subject to, and <br /> the Board' s commitment in the preceding paragraph is not <br /> effective until, ratification of this Agreement and Order by <br /> the Board no later than its August 10, 1984 meeting.
