.FINAL EXECUTION COPY <br /> future actions of the Company that violate the Porter-Cologne <br /> Act. <br /> XIII <br /> Nothing in this Agreement or Order shall be con- <br /> strued as exempting the Company from complying with all <br /> statutory and regulatory requirements, including permit <br /> requirements for operation of the facilities, except as <br /> provided in Section X. 1 of the Settlement Agreement with <br /> respect to any on-site surface impoundments. Nor shall <br /> anything in this Agreement or Order be construed to waive the <br /> Company' s applicable constitutional, statutory, or contrac- <br /> tual rights to contest or appeal any alleged deficiency or <br /> non-compliance with the requirements of the following: the <br /> ISD, the Operation Plan, any Permit, the Act, the Porter- <br /> Cologne Act, any orders or regulations adopted thereunder, or <br /> the terms of this Agreement and Order. <br /> XIV <br /> Whenever notification or submittal of documents are <br /> required of the Company under this Agreement, they shall be <br /> addressed to Mr. James Allen, c/o Toxic Substances Control <br /> Division, Northern California Section, California Department <br /> of Health Services, 4250 Power Inn Road, Sacramento, CA 95826, <br /> with a copy addressed to the Central Valley Regional Water <br /> Quality Control Board, 3201 S .
