Box 2498 <br /> Danville, CA 94526 <br /> Dear Mr. Roy: <br /> R&L DIESEL SERVICE, 2417 WEST LANE, STOCKTON <br /> This is in response to your July 2, 2004 and September 13, 2004 letters in which you request that <br /> the State Water Resources Control Board(SWRCB) issue a site closure letter for R & L Diesel <br /> Service. You describe your letter(s) as a petition seeking review of the San Joaquin County's <br /> (County)request for sampling and its failure to close your site. However, since there has not <br /> been a documented unauthorized release from an underground storage tank(UST) at this facility, <br /> the SWRCB does not have the authority to review the County's action. <br /> The SWRCB has authority to review only those actions taken by a local agency at a site subject <br /> to cleanup, abatement or other action conducted as part of the Local Oversight Program. [Health <br /> & Saf. Code, § 25297.1, subd. (h)]. h1 this case,the County has not confirmed that an <br /> unauthorized release occurred at R& L Diesel Service, and has not directed the responsible <br /> party(ies) to perform corrective action.
