Failing to record results of each inspection by the designated underground 3 storage tank operator in a monthly inspection report, in violation of California Code of 4 Regulations, title 23 section 2715(c); 5 s. Failed to maintain a copy of the monthly inspection record and all attachments 6 for the previous twelve months on-site, in violation of California Code of Regulations, title 23 7 section 2715(e); 8 t. Failing to maintain a list of facility employees trained by the designated 9 underground storage tank operator on-site, in violation California Code of Regulations, title 23 10 section 2715(fl(3). 11 5. Defendants, in the course of Defendants' GROCERY STORE/GASOLINE STATION 12 activities, are pursuant to Business and Professions Code § 17204 hereby permanently enjoined 13 from: 14 a. Violation of Health and Safety Code section 25100 et seq. described in 15 paragraph 3 - 3m above. 16 b. Violation of Health and Safety Code section 25280 et seq. described in 17 paragraph 4 - 4t above; 18 6. Defendants shall pay to Plaintiff the sum of THIRTY-FOUR THOUSAND 19 DOLLARS ($3 ,000.00), as and for civil penalties, pursuant to Business and Professions Code 20 section 17206. Said payments shall be made payable to the TREASURER OF SAN JOAQUIN 21 COUNTY and delivered to the San Joaquin County Office of the District Attorney, 22 Environmental Prosecutions Unit, as follows: 23 $7,333.50, at time of signing 24 $13,333.50, on or before December 15, 2008 25 $13,333.00, on or before June 15, 2009 26 7. Defendants shall pay to Plaintiff the sum of THIRTY-FOUR THOUSAND 27 DOLLARS ($34,000.00), as and for civil penalties, pursuant to Health and Safety Code §25299. 28 Said payment shall be madepavable to the SAN JOAQUIN COUNTY ENVIRONMENTAL 5 PERMANENT INJiJNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION
