Thornton Rd. , Thornton <br /> Public Health Services-Environmental Health Division (PHS-EHD) received your letter <br /> on January 26, 1994, concerning your objection to the underground tank fees for the <br /> above premise. <br /> Section 25284, California Health and Safety Code, requires that all new owners of <br /> underground storage tanks must apply for a operating permit within 30 days of <br /> assuming the ownership of a underground tank system. <br /> Section 25287, California Health and Safety Code, provides for the local agency <br /> (PHS-EHD) to charge program fees, including state surcharge fees to the owners <br /> and/or operators of underground tank systems. <br /> A fee schedule was approved for underground tank fees by the San Joaquin County <br /> Supervisors when the Environmental Health Division assumed responsibility for the <br /> underground tank program in January 1986. This fee schedule was revised as of <br /> January 1, 1991. <br /> Because, PHS-EHD was not advised of your ownership of underground tanks as required <br /> by Section 25289, California Health and Safety Code, all fees and penalties were <br /> due and payable when you came into compliance with this section in September of <br /> 1993. <br /> A review of your account revealed that you have paid state surcharges and closure <br /> fees for the permitted closure of the underground tanks at the site. Payments in the <br /> amount of $580.00 have been received by PHS-EHD to date. Fees and penalties 1991 <br /> have been removed from your statement. The PHS EHD accounting office has been <br /> advised of these changes.
