Box 2089 <br /> Stockton, CA 95201-2089 <br /> RE: Underground Storage Tank Fees and Penalties <br /> Dear Mr. Jahangiri, <br /> We have completed our review of your request for an adjustment in the delinquent under- <br /> ground storage tank fees for the four recently removed tanks on Port of Stockton <br /> property. <br /> Underground storage tank fees were adopted by the Board of Supervisors subsequent to <br /> legislation approved by the State of California which requires the registration of specific <br /> categories of underground tanks. If tanks have not been registered as required, five years <br /> of back fees, plus the year the tanks are discovered are due and payable. This <br /> requirement is based on an opinion from the San Joaquin County Counsel's Office taking <br /> into consideration the statute of limitations relating to the collection of back fees. <br /> It was indicated, in your letter of February 12, 1999, that the Port should not be <br /> responsible for back fees in that the tanks did not belong to the Port. You indicated that <br /> the Port became the de-facto owner upon their discovery on or about December 1998. If <br /> the Port was the property owner at the time the State legislation was adopted in 1983, or <br /> if the Port became the owner of the property after that date and there where visible tank <br /> appurtenances, the Port would be responsible for registration and the required fees. <br /> You indicated that the location of one of the four tanks was not known prior to the <br /> preparation to remove the three tanks which had visible appurtenances. In keeping with <br /> similar circumstances that have occurred on other properties that have had unknown, <br /> abandoned, or unregistered tanks, the delinquent fees for this tank will not be charged. <br /> Enclosed is an adjusted invoice for the three destroyed tanks.
