F=12b-12-99 04: 37P Port nfF Stockton HR Dept. 1 P. 02
r„
Part of Stockton ' BTO
Genewl+Jifices; P.O. Box 2089. Stockton,CA 95201-2089
(209)946-0246 l FAX(209)465-7244 or(209)4Be-5986
February 12, 1999
Transmitted Via Facsimile 209-464.0138
Mr. Al Olsen, R F_H_S_
Program Manager, Environmental Health Specialist
304 Weber Avenue, Third Floor
P.OBox 388
Stockton, CA 95201-0388
Dear Al,
I would like to thank you and Mr_ Doug Wilson of your staff for taking the
time to meet with Barry Nicholson of my staff and unyself on 2111199, during our
meeting, the Part of Stockton (Port) described to you that as a part of its
Underground Storage'rank(UST) program, the Port took the initiative through
reasonable inquiry and field inspections la identify any unknown USTs that
required to be replaced by December 22, 1998. As the result of that search, the
Port came across four unknown USTs that were removed and underwent proper
closure on or about January 5, 1999.
During our meeting, however, you indicated that since the four USTs were
not permitted by the Sari Joaquin County Heath Services/Environmental Health
Division (PHSfFHD), back fees and associated penalties totaling to $342.04
($170.00 for annual fees and $170.00 for penalty) per UST are due to the
PHS/EFID from the Port. In response to that, the Part indicated to you that the
subject USTs had been inactive for a long period of time, well before the effective
date of the implementation of the PHSfEHD's UST Management program on
January 1, 1986. More importantly, however, the Port described to you that
these USTs did not belong to the Port. In essence, the Port became the de-facto
owner of these UST upon their discovery on or about December 1998.
Nevertheless, the Port complied with the December 22, 1998 deadline and
properly removed them. ,As such, the Port believes that it should riot be subject
to the above referenced faes and penalties. Moreover, the Port believes that one
of these USTs did not have an outward sign of a UST (fill parts, vent pipes, etc)
and hence should be considered as a completely unknown UST.
GENERAL OFFICE; 2201 W. WASHINGTON ST-, STOCKTON, SAN JOAQUIN COUNTY, CALIFORNIA
