Box 388 <br /> Stockton, CA 95201-0388 <br /> Dear Al: <br /> I would like to thank you and Mr. Doug Wilson of your staff for taking the <br /> time to meet with Barry Nicholson of my staff and myself on 2111/99. During our <br /> meeting, the Port of Stockton (Port) described to you that as a part of its <br /> Underground Storage Tank (UST) program, the Port took the initiative through <br /> reasonable inquiry and field inspections to identify any unknown USTs that <br /> required to be replaced by December 22, 1998. As the result of that search, the <br /> Port came across four unknown USTs that were removed and underwent proper <br /> closure on or about January 5, 1999. <br /> During our meeting, however, you indicated that since the four USTs were <br /> not permitted by the San Joaquin County Heath Services/Environmental Health <br /> Division (PHS/EHD), back fees and associated penalties totaling to $342.00 <br /> ($170.00 for annual fees and $170.00 for penalty) per UST are dLIe to the <br /> PHS/EHD from the Port. In response to that, the Port indicated to you that the <br /> subject USTs had been inactive for a long period of time, well before the effective <br /> date of the implementation of the PHS/EHD's UST Management program on <br /> January 1, 1986. More importantly, however, the Port described to you that <br /> these USTs did not belong to the Port. In essence, the Port became the de-facto <br /> owner of these UST upon their discovery on or about December 1998. <br /> Nevertheless, the Port complied with the December 22, 1998 deadline and <br /> properly removed them. As such, the Port believes that it should not be subject <br /> to the above referenced fees and penalties. Moreover, the Port believes that one <br /> of these USTs did not have an outward sign of a UST (fill ports, vent pipes, etc) <br /> and hence should be considered as a completely unknown UST. <br /> GENERAL OFFICE: 2201 W.
