Box 2009 • (1601 East Hazelton Avenue) • Stockton, California 95201 <br /> �4FO��t <br /> (209) 468-3400 <br /> UNDERGROUND STORAGE TANK (UST) PROGRAM <br /> TITLE: Criteria For Evaluation Of Unknown UST's <br /> NUMBED: 93-008 <br /> EFFECTIVE DATE: January 1, 1993 <br /> SUPERSEDES: <br /> t f- <br /> APPROVED BY: /,-- DATE: x- <br /> The Environmental Health Division Fee Ordinance effective November 1, 1992, specifies <br /> back fees and penalties shall be assessed for any unregistered UST's discovered after the <br /> implementation of our UST Program on January 1, 1986, with a five-year statute of <br /> limitation on back fees and penalties. However, County Counsel has ruled that it is not <br /> the intent of the UST law to assess fees for unknown UST's. <br /> In some cases, unregistered UST's are present on a piece of property without the <br /> knowledge of the property owner. There are no visual or outward signs to the existence <br /> of UST's (fill pipes, vent pipes, dispensers) and property use is not consistent with the use <br /> of UST's. In addition, there is no documentation to the existence of an UST at the local <br /> fire jurisdiction, Aar Pollution Control District, or the Environmental Health Division. <br /> To evaluate if the existence of an UST is unknown and if back fees and/or penalties should <br /> or should not be assessed, utilize the following criteria: <br /> 1. Obtain the name of the owner/operator and how long they have owned/operated <br /> the property. <br /> 2. Determine what type of businesses exist or have existed on the property. <br /> 2. Contact the local fire jurisdiction to determine if any record of an UST is <br /> documented in their files. <br /> 3. Similarly, contact the San Joaquin Valley Unified Air Pollution Control District to <br /> determine if any record of an UST is documented in their files. <br /> Provide the information outlined above to the UST Unit Program Manager and Director of <br /> Environmental Health for evaluation and determination of "unknown status". <br /> A Division of San Joaquin County Health Cm Services <br />
