I any provision of Health and Safety Code Chapter 6.7 and 6.75. <br /> 2 4. By April 15,2002, defendant shall pay costs of 023E THOUSAND ONE HUNDRED <br /> 3 AND ELEVEN DOLLARS ($1,111.00) to San Joaquin County Public Health Services- <br /> 4 Environmental Health Division, as partial cost recovery in the matter. <br /> 5 5. By April 15, 2002, Defendant shall pay costs of SEVEN HUNDRED EIGHTY <br /> 6 DOLLARS ($780.00)to San Joaquin County District Attorney as partial cost recovery in the <br /> 7 matter. <br /> 8 6. Defendant shall be penalized TWENTY THOUSAND DOLLARS ($20,000.00) <br /> 9 based on Business and Professions Code Section 17206 for failure to comply with the 1995 <br /> 10 underground storage tank (UST) upgrade requirements. However, it is stipulated by all parties <br /> 11 that the entire TWENTY THOUSAND DOLLARS ($20,000.00) in civil penalties shall be stayed <br /> 12 until April 5,2005,on the condition that each of the following terms is met: <br /> 13 a) That defendants do not violate any provisions of Health and Safety Code <br /> 14 Chapters 6.7 and 6.75- <br /> 15 b) If defendant fails to eomply with paragraph 6(a),then the TWENTY <br /> 16 THOUSAND DOLLARS ($20,000.00) shall be immediately paid. <br /> 17 C)If, as of April 5,2005, Defendant has complied with Paragraph 6(a), then this <br /> 18 judgement shall be deemed satisfied without payment by Defendants of the sum of TWENTY <br /> 19 THOUSAND DOLLARS ($20,000.00). <br /> 20 7. This judgment shall go into effect immediately upon entry thereof. Entry is authorized <br /> 21 immediately upon filing. <br /> 22 1 8.
