I any provision of Health and Safety Code Chapter 6.7 and 6.75. 2 4. By April 15,2002, defendant shall pay costs of 023E THOUSAND ONE HUNDRED 3 AND ELEVEN DOLLARS ($1,111.00) to San Joaquin County Public Health Services- 4 Environmental Health Division, as partial cost recovery in the matter. 5 5. By April 15, 2002, Defendant shall pay costs of SEVEN HUNDRED EIGHTY 6 DOLLARS ($780.00)to San Joaquin County District Attorney as partial cost recovery in the 7 matter. 8 6. Defendant shall be penalized TWENTY THOUSAND DOLLARS ($20,000.00) 9 based on Business and Professions Code Section 17206 for failure to comply with the 1995 10 underground storage tank (UST) upgrade requirements. However, it is stipulated by all parties 11 that the entire TWENTY THOUSAND DOLLARS ($20,000.00) in civil penalties shall be stayed 12 until April 5,2005,on the condition that each of the following terms is met: 13 a) That defendants do not violate any provisions of Health and Safety Code 14 Chapters 6.7 and 6.75- 15 b) If defendant fails to eomply with paragraph 6(a),then the TWENTY 16 THOUSAND DOLLARS ($20,000.00) shall be immediately paid. 17 C)If, as of April 5,2005, Defendant has complied with Paragraph 6(a), then this 18 judgement shall be deemed satisfied without payment by Defendants of the sum of TWENTY 19 THOUSAND DOLLARS ($20,000.00). 20 7. This judgment shall go into effect immediately upon entry thereof. Entry is authorized 21 immediately upon filing. 22 1 8.
