Box 2009 Stockton, California 95201-1257 <br /> Stockton, California 95201 <br /> Gentlemen: <br /> It is my understanding that Mr. Hoblitzell has made an inquiry to Mr. Doug Wilson, Tank <br /> Removal Supervisor(unit III)regarding properly which I recently inherited. Mr. Hoblitzell did so <br /> on my behalf and with my authorization. The facts regarding the property located at 4245 E. <br /> Main Street, Stockton, California are as follows. <br /> I was born in stockton and have memories of the property as a child. My Aunt had a grocery <br /> store on this property in the 1940's and 1950's. During this time period there was never any use <br /> of the property as a gasoline station. I have checked with relatives in my family who have <br /> indicated they have no recollection of the property ever being used as a gas station back in 1940. <br /> In fact I can find no one who can remember the site even being a gas station. In the 1960's and <br /> 1970's, the property was operated as Imogenes Beauty Saloon. In the late 1970's and until the <br /> early 80's, a number of tenants operated the site as various retail stores. In the early 80's and until <br /> now, the site has been operated as Town and Country Hay&Feed. <br /> My grandmother owned the property and on her passing, I inherited the property. The estate <br /> has been settled and I have been given clear title to the property. I informed the current tenant, <br /> that since I reside in Virginia I would be interested in selling the property. The tenant was <br /> interested in purchasing the property. During very recent discussions, the tenant informed me of <br /> the existence of possibly three underground tanks; evidence of which indicated there presence <br /> during installation of sewer lines. I grew up on the adjacent property the 40's and know that no <br /> one ever indicated or had knowledge of any underground tanks. Further, over the years, Main <br /> Street has been widened and the height of the ground in that area has been raised about two or <br /> three feet. Had it not been for the sewer lines being connected to the property, the presence of <br /> these tanks may never have been known. I have received legal advice advising that it would be <br /> prudent to have the tanks replaced. <br /> Mr. Hoblitzell has advised me that conversation with Mr. Wilson has indicated that there <br /> should be no back fees or assessments made by San Joaquin County as it is obvious these tanks <br /> have been out of operation since at least prior to 1940. There was no law reguiring any specific <br /> abandonment procedures then and the law has therefore been complied with. It is my desire to <br /> comply with the proper procedures for removing the tanks as the environmentally proper thing to <br /> do. I have engaged Falcon Energy to remove the tanks and acknowledge that I appoint them as <br /> my agent relative to submitting removal application, signing required manifests on my behalf and <br /> similar tasks associated with the removal of these tanks including obtaining a temporary EPA I.D. <br /> number required for tank disposal. <br />
