Office of Revenue and Recovery
Attention: Lynn Smith
June 8 , 1998
Page Two
these properties . My client will also be prepared to
expend up to a maximum of $10 , 000 . 00 to secure
environmental clearances on the subject properties . As
part of my client 's offer, assuming that there is required
more than $10, 000 . 00 in environmental remediation of the
property, my client would be in a position to spend an
additional $60, 000 . 00 toward the remediation so long as
that acted as a credit against the purchase price for the
subject property;
2 . In conjunction with this proposal, my clients
will also clear all refuse and debris from the subject
properties including but not limited to tires, concrete,
refuse, weeds and level the properties as needed to
complete the on-site remediation. These tasks will not act
as a' credit toward the $10, 000 . 00 or any potential amount
exceeding that $10 , 000 . 00 as above-referenced. My clients
anticipate that these efforts will take a substantial
amount of time and cost given the refuse located on the
subject properties;
3 . My clients are also prepared to erect a fence
around the North Hubbard property, and put a fence on the
frontage of the Marsh property in conjunction with his work
to clean up the subject properties;
4 . ' This agreement would obviously be contingent
upon the County of San Joaquin releasing all liens
including but not limited to taxes, assessments and such
other actions that they have effecting the subject
properties so that my clients can restore appropriate title
in their names and seek to develop the subject properties .
This proposal is also contingent upon my clients being able
to enter into a valid contract towards the purchase of
these properties from Mr. Cloud. It is anticipated that
Mr . Cloud will be paid no monies for these properties , and
in fact the purchase price will be paid to the County of
San Joaquin as above-referenced;
