<br /> I. CASE SUMMARY
<br /> On July 17, 1992, San Joaquin County Public Health Services, Environmental Health Services (PHS-EHD) received
<br /> complaint #92-1363. The complaint alleges that Shockey and Sons Trucking located at 850 Milgeo, Ripon, CA, "has
<br /> underground storage tanks which are not being used or tested". The tanks have allegedly been there 20 or 30 years.
<br /> On August 4, 1992, PHS-EHD investigated the complaint and found evidence to substantiate the claim (fuel dispensers,
<br /> vent risers, one tank had been excavated and stored on the property). An employee,Time Rose,stated that at least one
<br /> of the tanks was in use.
<br /> On August 12, 1992, the business owner, Wayne Shockey, called PHS-EHD and provided pertinent information so that
<br /> an underground storage tank file could be created. The inspection report,closure plan contractor list,permit application,
<br /> and facility and tank fees were mailed to Shockey and Sons Trucking, P.O. Box 177, Ripon, CA, 95366, on August 13,
<br /> 1992.
<br /> Since no response to the inspection report and timelines was received by Wayne Shockey, a Notice of Administrative
<br /> Hearing was mailed on November 30, 1992. The hearing was scheduled for December 8, 1992 at 1:30 p.m.
<br /> Mr. Shockey did not show up for the hearing but did request by phone that PHS-EHD mail him a copy of all
<br /> correspondence to date. PHS-EHD again mailed a copy of the August 4, 1992 inspection report, a permit application,
<br /> closure plan, inventory reconciliation form, annual report form, and statistical inventory form. A memo was also sent
<br /> which requested that Mr. Shockey submit a closure plan or a tank(s) monitoring plan by January 16, 1993.
<br /> On February 18, 1993,PHS-EHD contacted Mr.Shockey. Mr.Shockey intends to remove these tanks, however,he does
<br /> not have the money. Shockey has not yet paid any fees.
