The tanks were taken aut of service in 1969 and fiied with
sand in 1970 . The existence :f the tanks were recently revealed to
the property owner who intends to remove the tanks under proper
permit procedure .
Your questions :
1 . Would the property owner owe any past fees or penalties of any
kind?
Since the subject tanks were decommissioned (rendered such that
they could not have inputs or withdrawals by having been filled
with sand) in 1970 , and the property owner was not aware of the
tanks or ally contamination from the tanks, l am not aware of any
past fees or penalties that would apply.
2 . Should contamination be present , would this owner qualify for
the underground storage tank cleanup fund?
Provided that the tanks once stared petroleum and provided that the
property owner has had the tanks and any resultant contamination
abandoned to him by the legal. tank owner, I see nothing to make a
claim ineligible .
If you have any further questions, please call me at (916) 739-
4484 .
post-it",grand tax transm ttal memo 7671
To
-{ / From Gf
C°.
C4 e 5' 42
