DATE ACTIVITY ACTION RECORDED BY 02/10/03 Received Compliant stating that an Underground Storage Tank(UST)had been SCS removed illegally this date around 12 to 13 PM at 90 Mt.OSO Tracy. I arrived on site meeting Kerry Simpson(City of Tracy Community Preservation Manager), Pat Zona(City of Tracy,Code Enforcement),Mark Mehring(City of Tracy,Fire Department)and Mark Richardson(City of Tracy,Fire Department). There was an approximately 300—400 Gallon UST sitting on East site of this property. Neighbor(Mr. &Mrs.Pennell)told me that this tank was removed around noon today by W.C.Maloney. W.C.Maloney removed the tank from underground and backfill the hole and put the removed tank on the same location. There are two —2"openings and one—1"openings on top of the tank. There was some liquid with hydrocarbon smell inside the tank. There is no sign of spillage around the tank. In addition,there is an abandoned well sitting on middle of the property about 140 South of the street. The sanitary seal is not proper secured,and there are holes around the decayed steel casing. Mrs. Simpson told me the property owner is Mr.Danny Benjamin,and the contractor is W.C.Maloney. Captain Richardson took the reading of the tank and found out that the 14%LEL from the tank opening,which indicates the material inside is flammable liquid. Mrs. Simpson will contact if the owner will hire the contractor to correct this hazard or city will correct it and bill to the owner. I stated that the open well shall be secured until this well is destroyed under permit and inspection from this office. I secured the well with a blue recycle bin (borrowed from Mrs.Pennell)with cou le concrete blocks on top. 02/11/03 I received E-mail from Mrs. Simpson stating the owner's information. Then I SCS spoke to Mr.Benjamin(Cell: 815-1280;home: 830-9712;fax: 830-7718)whom is informed about the situation. Mr.Benjamin told me that Mr.Glan Swesy(Cell: 608-7774)of W.C.Maloney is the foreman of the job. I then called Mr. Swesy and found out that the septic destruction permit is SR0032551;and the well destruction is sub-contracted to Clark Well. Mr. Swesy has no idea when the tank removal is an issue. I received phone call from Mr.Benjamin providing EPA number is CAC0002561721,and he had sub-contracted to Richard Lowry of George Lowry, Inc.to remove this tank. Mr.Benjamin does not understand why this tank is regulated,and he is quite upset about what's required to remove this tank. A certified mail of Notice to Abate was mailed. 02/12/03 Mike Clark of Clark Well e-mail me to confirm that he has an agreement with SCS W.C.Maloney to destroy the abandoned well. Mr.Benjamin and Mr.Lowry called my supervisor Doug Wilson,and Mr.Wilson fax them the requirements and a copy of LG109-1 stating why this tank is regulated tank. 02/14/03 I Received a phone call from Mr.Richard Lowery stating that the tank had been SCS removed. He will submit paper work later. 02/20/03 Filed return recei t of certified mail. SCS 03/19/03 Filed document of tank removal from Mr.Richard Lowery. Mr.Lowery called SCS and stated that he only did the tank removal. Mr.Benjamin will need to contract another contractor to do the actual paper work permit and sampling. 03/21/03 Fax response letter to Mr.Richard Lowery&Certified mail to Mr.Danny SCS Benjamin. 04/10/03 Received a fax copy of proposal for permit application preparation&Soil SCS sampling collection from Mr.Danny Benjamin. I called Mr.Benjamin,and he told me I should contact Mr.Bob Marty of Advanced GeoEnvironmental Inc. AGE to find out more detail.
