In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> SJC EHD inspectors witnessed fuel leaking from the secondary containment piping into the 89- <br /> octane STP sump during annual Monitoring System Certification on on June 27, 2013, and during the <br /> SB989 Secondary Containment Testing on June 28, 2013. This is a violation of California Code of <br /> Regulations CCR Section 2631(a), which states that the primary containment of underground storage <br /> tanks must be product-tight. <br /> Immediately discontinue use of failed piping, determine the source of the leak, and have a properly <br /> licensed, trained, and certified contractor replace or repair the failed piping under permit and <br /> inspection of the EHD. Submit a permit application to replace or repair the failed piping to EHD by <br /> August 18, 2013.
