In determining whether a violation is <br /> chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the <br /> violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including <br /> corrective action). <br /> Per the March 2016 and March 2017 Monitoring System Certification inspection reports, the following violations were <br /> identified and have not been corrected for the Underground Storage Tank (UST) system at the address above: <br /> -Secondary containment testing was last performed on July 14, 2015. According to the test results from July 2015, the 8 <br /> north piping line and the Under Dispenser Containment (UDC) 11112 were not tested. Testing has not been complete <br /> and is 30 months past due. Secondary containment is required once every 36 months (CCR 2637). Immediately schedul <br /> testing for mentioned components and provide 48 hours notification to the Environmental Health Department (EHD). <br /> -The July 14, 2015 secondary containment test results indicate a failure at the 91 annular, UDC 516 and UDC 9110. Al <br /> secondary containment for the UST system must be tight (HSC 25291). Immediately have a properly licensed, trained an <br /> certified contractor repair or replace the failed components under permit and inspection of the EHD. <br /> As a result of the non-compliance, a permit to operate the UST system has not been issued. No person may own o <br /> operate an UST unless a permit for its operation has been issued by the local agency to the owner or operator of the tan <br /> (HSC 25284).
