In determining whether a violation is chronic or a violator is recalcitrant, the local agency shall consider whether there is evidence indicating that the violator has engaged in a pattern of neglect or disregard with respect to any requirement in Title 23 (not including corrective action). Per the March 2016 and March 2017 Monitoring System Certification inspection reports, the following violations were identified and have not been corrected for the Underground Storage Tank (UST) system at the address above: -Secondary containment testing was last performed on July 14, 2015. According to the test results from July 2015, the 8 north piping line and the Under Dispenser Containment (UDC) 11112 were not tested. Testing has not been complete and is 30 months past due. Secondary containment is required once every 36 months (CCR 2637). Immediately schedul testing for mentioned components and provide 48 hours notification to the Environmental Health Department (EHD). -The July 14, 2015 secondary containment test results indicate a failure at the 91 annular, UDC 516 and UDC 9110. Al secondary containment for the UST system must be tight (HSC 25291). Immediately have a properly licensed, trained an certified contractor repair or replace the failed components under permit and inspection of the EHD. As a result of the non-compliance, a permit to operate the UST system has not been issued. No person may own o operate an UST unless a permit for its operation has been issued by the local agency to the owner or operator of the tan (HSC 25284). The site must be brought into compliance to avoid your entire LIST system being red tagged withi 7 (seven) days from the receipt of this Notice.
