The following is a <br /> Minor Violations - Notice to Comply: 104, and Class II Repeat violations: 313, 314 <br /> 104. Current financial responsibility documents have not been submitted to the EHD, in spite of the <br /> statement in the CERS website that the documents have been provided to EHD. Current financial <br /> responsibility documents are required to be submitted annually. Immediately submit a copy of the <br /> financial responsibility documents to the EHD. Alternatively, log into CERS, upload the required <br /> information, and submit for review by the EHD. Received a copy of the current documents on site; <br /> Violation was corrected on site. <br /> 313 (Repeat). The direct-bury spill container of the main red-dye diesel UST was not tested. All spill <br /> containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill <br /> until it is detected or cleaned up. Immediately discontinue deposition of petroleum into this tank until the <br /> component is repaired or replaced by a properly licensed, trained, and certified contractor under permit <br /> and inspection of the EHD. If the spill container can't be replaced immediately, there is a possibility that <br /> the UST system may be red tagged to prevent fuel inputs. (See 314 below) <br /> 314 (Repeat). Based on interview with technician and consistent with what EHD had observed during <br /> the previous MSC inspection on 4/4/2013, the drop tube with the mechanical flapper used as the overfill <br /> prevention system is missing from the main red-dye diesel UST. Immediately discontinue deposition of <br /> petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and <br /> certified contractor under permit and inspection of the EHD. If the failed component can't be replaced <br /> immediately, there is a possibility that the UST system may be red tagged to prevent fuel inputs. The <br /> main red-dye diesel UST currently receives fuel only through the syphon connection to the adjacent <br /> auxiliary red-dye diesel tank. If you wish to discontinue use of this fill port and spill container, submit a <br /> proposal in writing to EHD by 5/3/2014 how the spill container is decommissioned and locked to prevent <br /> possibility of any fuel input, and update the Monitoring Plan in CERS to reflect this change. <br /> Note: EHD reported the above spill container was once capped off and drop tube removed on 4/6/2011 <br /> but anew spill container was reinstalled in 2012.
