MISC#4\FILES\9750SPEC Page 4 of 22 <br /> 8 . The following instructions shall apply to sale in usable <br /> condition, sale as junk, or contract removal and disposal <br /> of any tank: <br /> a. Contractor agrees to take title to used storage tanks <br /> {� 1 � and dispose of them in a safe and lawful manner. <br /> (Contractor understands that such tanks have been <br /> used for the storage of leaded gasoline and are unfit <br /> for the storage of edible or potable products. ) <br /> Owner shall in no event be liable to Contractor for <br /> any claims, demands, damages or liability arising out <br /> of the disposal or any use of these storage tanks, <br /> and Contractor agrees to hold Owner harmless and <br /> release, protect, defend, and indemnify Owner for <br /> such claims, demands, damages or liability whether <br /> Owner is negligent actively, passively or not at <br /> all. <br /> Tank which has contained leaded gasoline may give off <br /> extremely toxic vapor when heated as by welding or <br /> cutting. <br /> b. A shipping tag, rubber-stamped with the following <br /> statement, shall be wired securely around a plug in <br /> one side of the tank openings: ("THIS TANK NOT SAFE <br /> FOR ANY MATERIAL DESTINED FOR HUMAN OR ANIMAL <br /> CONSUMPTION.- IT MAY HAVE BEEN USED FOR GASOLINE <br /> CONTAINING TETRAEHYL LEAD, A POISON. ") <br /> 9. Tanks that are damaged or leaking excessively and are <br /> l unfit for other disposition, may be hauled to an <br /> Lestablished public dump or junk pile provided they are <br /> mutilated to an unreclaimable extent to prevent retrieval <br /> for any purpose. <br /> 10. If the steel is to be sold for scrap and possible <br /> remelting in the manufacture of new steel, all interior <br /> surface of any plates which have been in contact with <br /> sludge should be sandblasted or wire-brushed to bare <br /> metal. <br /> 11. PROVIDE OWNER WITH RECEIPT FROM DISPOSAL COMPANY. <br /> 12 . Remove tanks, product and vent piping in excavation from <br /> site at the earliest time possible. DO NOT DELAY <br /> DISPOSAL. Permanently abandon remaining product lines <br /> (from pump islands to tank area) by filling lines with a <br /> concrete slurry, or flush with water, and cap if <br /> permitted by local regulations. I �+r' <br /> 13 . Company Rep. and Contractor shall inspect open excavation <br /> for evidence of product leakage. <br />
