Frontage Road to this property, for the purpose of ensuring the food facility met the
requirements for operating a food facility. The restaurant operator indicated the water for the
facility was being supplied by the City of Ripon. At the time of the inspection, there was no
"Warning"to the public posted regarding the water exceeding the drinking water standards for
nitrates that would have been an indication to the EHD staff that the water supply was not from the
City of Ripon. The EHD issued a permit to operate the food facility on June 30, 2006.
On July 26,2006, the EHD staff that inspect small public water systems found that the Giovanni
Pizza Restaurant had moved to this property and uses water from the Jimco Water System. The
Jimco Water System water exceeds the 45 parts per million (ppm)maximum contaminant level
(MCL) established for nitrate in water that is supplied to the public. The Giovanni Pizza
Restaurant operated from June 30 until July 26, 2006, using water from the Jimco Water System
for all food preparation and drinking purposes, which is in violation of the California Code of
Regulations(CCR), Title 22, Section 64431 (a).
The EHD issued a temporary permit for operation of the Giovanni Pizza Restaurant, with the
conditions that Public Notification is continually posted at all sites of water use and only approved
bottle water is used for all food preparation and drinking purposes. The temporary permit will be
revoked on October 1, 2006. If this property is not receiving water from the City of Ripon Water
Utilities by October 1, 2006,the Giovanni Pizza Restaurant will be ordered closed by the EHD.
The Jimco Water System failed to comply with the EHD orders issued in the November 14, 2005,
Notice of Violation, to continually post public notification, to provide approved bottle water for all
drinking and food preparation uses, and failed to submit to the EHD the receipts each quarter for
the purchased water.
