Hickox <br /> Secretaryfor <br /> Environmental <br /> Protection <br /> July 22, 2003 <br /> To: Whom it may concern <br /> Re: FULLY ENCLOSED MOVABLE CONTAINER EXCLUSION <br /> Recent changes in Title 14, California Code of Regulations (CCR), removed the fully enclosed <br /> movable container exclusion, 14 CCR 18420(a)(5), from the waste tire regulations. A new term <br /> called"collection"has been added to the regulations and is defined in 14 CCR, 17225.717 <br /> (included on page 2 of this letter). Tires are considered to be in the "collection" process, as <br /> opposed to "storage," when they are temporarily (less than 90 days) placed in fully enclosed, <br /> licensed road transportable containers. When tires are not being loaded or unloaded, operators <br /> are to keep the containers closed and locked or provide a sufficient access control such as <br /> perimeter fencing. All tires transported to and from a collection facility are to be properly <br /> manifested. A collection operation is not required to obtain a waste tire facility permit. <br /> Operators storing waste or used tires in cargo boxes, seatrains, drop-off boxes or any other types <br /> of fully enclosed movable containers do not meet the collection definition unless those <br /> containers are stored on a licensed road transportable trailer. <br /> If you were operating under the fully enclosed movable container exclusion, contact the <br /> California Integrated Waste Management Board (Board) in writing by August 25, 2003. Briefly <br /> describe your methods of operation, container type, the maximum amount of tires you store, if <br /> you believe your operation meets the definition of collection, and what action you plan to take to <br /> secure authorization for tire storage at your facility. The information you provide will help us <br /> determine if you need a permit or meet the definition of collection. <br /> We encourage you to contact Board staff to help you figure out which type of authorization best <br /> fits your operation. We want to work with you to obtain the necessary approvals.
