Waste Tire Enforcement Policy on Collection, 14, CCR 17425.717 <br /> Fully enclosed, licensed road transportable containers: Tires are considered to be in the <br /> "collection"process, as opposed to "storage,"when they are temporarily (less than 90 days) <br /> placed in fully enclosed, licensed road transportable containers. Operators storing waste or used <br /> tires in cargo boxes, seatrains, drop-off boxes or any other types of fully enclosed movable <br /> containers do not meet the collection definition unless those containers are stored on a licensed <br /> road transportable trailer. <br /> What is Fully Enclosed? <br /> Fully enclosed trailers can include open top truck trailers that use tarps to fully enclose the <br /> trailers when they are not in the loading and unloading process. If tarps are used, they should be <br /> water tight allowing no infiltration of water or vectors. Enforcement staff will determine <br /> whether or not the tarping method or tarp type is adequate to fully enclose the trailer. Tires <br /> stored in open top trailers overnight must be tarped. <br /> How do we determine if the fully enclosed road transportable containers are licensed? <br /> Check to make sure that the license is for the current year regardless of the state in which the <br /> vehicle is registered. If it is not obvious from the license plate, ask the operator to show the <br /> paperwork. If the vehicle, trailer does not have the current year registration in one state or <br /> another, it does not meet the definition of a collection. <br /> Can Tire Dealers and auto dismantlers have 1,500 waste tires plus fully enclosed truck <br /> trailers that qualify as collection stored at their site with out incurring violations? <br /> No. 1,500 waste tires is the limit. Storing over 1,500 waste tires at these facility types is <br /> considered a violation. <br /> Are collection operators required to notify the Board regarding their operations? <br /> Yes. Waste Tire Haulers are can only transport waste or used tires to facilities or locations that <br /> are legally authorized, PRC 42951(b). The Board must verify that a facility meets the definition <br /> of Collection prior to authorizing them to receive tires. The operator of an existing Collection <br /> Facility or a proposed Collection Facility should contact the Board in writing describing their <br /> operations and how they meet the definition described in 14 CCR 17225.717. The operator must <br /> also provide operator information (name, phone, mailing address) & owner information(name, <br /> phone, mailing address) and the facility address. <br /> Upon receiving such notification, staff will visit the facility to verify that the facility qualifies as <br /> a Collection Facility. If the operation is still in the conceptual stages, staff will review the <br /> notification to determine if the proposed operation meets the collection definition. For the <br /> facilities which are not yet operating, an inspection will be completed at a later date, after the <br /> facility is up and running. Once the inspection or review is completed and the facility is <br /> determined to meet the collection definition, staff shall assign a SWIS number and enter the <br /> activity type as a Collection Facility and Regulatory Status as excluded with an inspection <br /> frequency of 30 months. Once entered into SWIS, the waste tire hauler will be able to verify that <br /> the facility or location is authorized to receive waste or used tires. <br /> How often should we inspect a Collection Facility? <br /> The Collection facility should be inspected at least every 30 months. This does not prohibit <br /> more frequent inspections as determined necessary by the inspector on a case-by-case bases. <br /> s:WT management Branch/P&E/Collection Enforcement Policy I <br />
