Jennifer L. Ruiz [EH]
From: Niles, Laura[Iniles@CIWMB.ca.gov]
Sent: Wednesday, April 19, 2006 7:44 AM
To: Garrett T. Backus [EH]; Jennifer L. Ruiz [EH]
Cc: Smith, Terry
Subject: Colletion Definition for Brandon Tires
Jenni and Garrett,
Just your FYI. Let's meet somewhere at 9:30 to discuss before we see Mr. Brandon?? I spoke with Terry Smith
and they allowed that storage method (containers) before this definition was available. All sites were sent lots of
notices that the old container definition did not meet the new standard. Terry and our old folks here, (Steve
Posner and Cody Begley) have worked a lot with this guy and he knows the laws.
Terry, what year did this definition become regulation?? Keith Cambridge remembers this location from 10 years
ago. Laura
17225.717. Collection.
Waste tires are considered in the "collection" process when they are temporarily placed in fully
enclosed, licensed road transportable containers that are not stored at a permitted waste tire facility or a
facility identified in Section 18420(a). The requirements of Article 5.5 of this Chapter and Chapter 6,
with the exception of Article 8.5, Chapter 6, shall not apply to "collection" as long as the following
conditions are met:
(1) Containers shall be kept closed except while loading and unloading.
(2) Containers shall be kept locked when not being loaded or unloaded unless unauthorized
access is controlled pursuant to section 17352 of this Article.
(3) All waste tire deliveries shall be manifested in accordance with Article 8.5 of this
Chapter.
(4) For the purpose of this section "temporarily" shall mean less than 90 days.
4/19/2006
