(See CalRecycle Stipulation, Decision,and Order,EXHIBIT 1 and Attachment(s).CalRecycle has a streamlined penalty process to save itself and your company time and money if your company and CalRecycle can agree on a settlement quickly. In order to do so,you must sign the attached order agreeing to the violations and send CalRecycle the order and a check within 15 days after this letter is delivered to you. If you do not ask for the streamlined penalty process before the 15 day deadline, then CalRecycle will start the standard penalty process that allows you to request a hearing. The two penalty processes are described below. Standard Penalty Process • CalRecycle staff recommends a standard penalty of$7,000 for the tire hauler and/or tire manifest violations shown in yellow highlights in Exhibit 1 and Attachment(s). • CalRecycle will write an Administrative Complaint for$7,000 in penalties against your company as required by law(Administrative Procedures Act at Government Code Section 11500, et. seq). • When you get the Administrative Complaint you may ask for a hearing. • The hearing will be held before CalRecycle's Director or a person delegated by the Director. The Director,or the Director's delegate,will make a decision based on the facts and may order you to pay the full penalty requested in the Administrative Complaint. OR Streamlined Penalty Process • CalRecycle staff recommends a streamlined penalty of$2,050 for the tire hauler and/or tire manifest violations as shown in Exhibit 1 and Attachment(s). (For penalties of 5.500 or more, payment installments can be arranged;please contact Keith Cambridge at (916) 341-6422 if you are interested). • You review the attached Stipulation, Decision, and Order, including Exhibit 1 and Attachment(s), that shows the violations in yellow highlight.
