Beneficial Reuse of Waste Tires <br /> Title 14 California Code of Regulations § 17346(f) For the purposes of this Article and Article <br /> 5.5 of this Chapter, disposal and storage of waste tires does not include the beneficial reuse of <br /> waste tires as the Board may determine on a case-by-case basis. <br /> (1) Beneficial reuse of altered waste tires is permitted provided the beneficial use does <br /> not pose a threat to public health, safety and the environment. <br /> (2) In order to qualify as a beneficial use, the proposed use must employ one or more of <br /> the engineering properties of waste tires and provide equal or superior performance or <br /> lower cost relative to conventional technologies and the proposed use must be <br /> approved in writing by a registered civil engineer. <br /> (3) An application to determine if a project is considered a beneficial reuse must be made <br /> in writing to the EA and the Board. The EA and the Board will evaluate the proposed <br /> project under the criteria set forth in subsections 17346(f)(1) and (2) and will <br /> independently determine and notify the applicant whether the proposed project <br /> constitutes a beneficial reuse of altered waste tires within ninety (90) days from their <br /> receipt of the application. <br /> What the applicant must do to gain approval: <br /> 1) Have the proposed project designed by a civil engineer registered in the state of California <br /> 2) Obtain written approvals of the proposed use from the appropriate local agencies including but <br /> not limited to the following: <br /> a.) Local Planning Department <br /> b.) Local Fire Department <br /> c.) Local Vector Control Authority <br /> 3) Submit to the California Integrated Waste Management Board the proposed project with all <br /> local approvals and a description and time line detailing how the project will be carried out. <br /> What we do when we receive an application for Beneficial Reuse: <br /> Once we receive the project proposal and applicable approvals we will complete our review <br /> within 90 days. Approval includes the following: <br /> 1) Permitting staff review submittal and request project design review by Closure and <br /> Remediation staff engineers <br /> 2) Acceptable applications have all local approvals and contain sound beneficial reuse <br /> design plans that are stamped by a CA registered civil engineer <br /> 3) For acceptable applications, the permitting staff prepares a memo providing a summary <br /> of staff analysis and the proposed project for the SWD Deputy Director. An approval <br /> letter, with specific conditions for the project is prepared for DD signature and sent out to <br /> the proponent. <br /> 4) Unacceptable proposals will be rejected in writing delineating why the project was not <br /> considered a beneficial reuse. <br />
