Subsequent investigations and <br /> reporting show maximum contaminant concentrations in groundwater at 96,000 micrograms per liter(µg11)total <br /> petroleum hydrocarbons as gasoline (TPHg), 7,500 µg11 benzene, and 450 pµgll 1,2-dichloroethane. The San <br /> Joaquin County Environmental Health Department(County) documented that limited soil and groundwater <br /> ber 1996 and August 1999;"however, more recent site <br /> investigations were completed between Decem <br /> investigation and reporting has not been completed in a timely manner. <br /> E Il <br /> On 30 August 2000,the County approved the 31 July 2000 Addendum to Workplan fo/Additional Investigation <br /> (Workplan Addendum) submitted by JJW Geosciences,Incorporated(JJW) for the subject site. Mr. Jess <br /> !�i <br /> Cervantes,the responsible party,was directed by the County to implement the approved Workplan Addendum in <br /> January 2001 and again in March 2001 (copy of County letter attached). The Workplan Addendum was.not <br /> implemented until May 2001, and an Assessment Report was not submitted until 14 November 2001,thus,fifteen <br /> months after the Workplan Addendum was approved. After reviewing the Site Assessment Report,the County <br /> = �� <br /> directed you to submit a plan of work to conduct a feasibilitystudy by-2.lJanuary__2002:_Based on your failure tom, <br /> submit the required plan of work, and general disregard for County directives,the County has referred the site to <br /> the Regional Water Quality Control Board for regulatory enforcement. <br /> In addition to delinquent workplans and investigation reports,you have failed to complete and submit quarterly <br /> monitoring and progress reports as required Y uired b Title 23 Chapter 16,Article 5, Section 2652 {c and d)of the <br /> California Code of Regulations(UST Regulations). We have not received the second,.third, or fourth quarter <br /> monitoring and progress reports for 2001, and as indicated by JJW on 2 April 2002, groundwater monitoring and <br /> sampling for the first quarter of 2002 has not been completed.
