Actually,the last meeting was held on November 9, 2005, and the meeting was at the <br /> request of Apex(E-mail attached). I'm sorry I was not able to be at that meeting, I was ill with a fever etc. and <br /> certainly didn't know that wouldhappen when the meeting was agreed to. Mike was at your site inspecting the <br /> installation of monitoring wells. We both plan to be at the meeting this Thursday and Jim Barton plans to be there <br /> also. I checked with the UST compliance staff in our office and apparently the vapor recovery bucket on the <br /> gasoline UST system failed on January 18, 2006. 1 also was informed that UST systems installed prior to July 1, <br /> 2003,were not required to have secondary containment on the vapor lines so the vapor lines on the UST systems <br /> at your site are single walled and not monitored. As I told you on the telephone after overseeing corrective action <br /> at hundreds of sites, the highest concentrations of contamination are always in the source area as we see at your <br /> site. I talked with Tom Landwehr, of <br /> Apex, and he has expressed concerns regarding the direction of the do's and don'ts from EHD and the <br /> CVRWQCB. Tom also expressed concerns that the EHD may be pressing for closure of the Chevron <br /> location next door to me. You have mentioned several times to me that I am the responsible party for the <br /> clean up of the MTBE in the groundwater by my facility, yet I passed the tracer test. I conferred with Mike <br /> Walton of Walton Engineering who coordinated the said test, and has maintained this station, as well as, <br /> built the fuel facility at Flag City, and he does not see how it is possible that my station could be <br /> responsible for this magnitude of contamination without any obvious leaks or spills or anything else that <br /> would cause us to become "the responsible party". <br /> Yet, as I mentioned over the phone, I will always be responsible and will take full responsibility for my <br /> actions and my personal and real property. You all requested a meeting last October, 2005,yet the main <br /> people involved, Mike Infurna, and Margaret Lagorio did not show up. I did. <br /> I am requesting that the meeting that you scheduled for Thursday continue. However with one stipulation, <br /> this meeting will continue only if you Margaret, and Mike Infurna, and the rest of the folks show up. I have <br /> forwarded this email to Spencer Malysiak, my attorney so that he may become familiar with the <br /> discrepancies and irregularities of this subject. I do not think that Spencer needs to be at this meeting <br /> Thursday. Thursday's meeting should be a friendly,fact finding mission to discuss all issues and to protect <br /> the groundwater and limit any contamination to the soil,water, or air. <br /> As for requesting who becomes the lead agency, let's talk it through on Thursday.
