For the period not to extend beyond April 1, 1996 , CFNR Railroad hereby permits Contractor <br /> and Sub-Contractor to enter upon property of CFNR Railroad in the vicinity of the Station of Lyoth, M.P. <br /> 85.2 on the Tracy to Los Banos line, County of San Joaquin, California, as may be necessary in <br /> connection with work to be performed on Railroad premises by Contractor and Sub-Contractor of <br /> monitoring well installations for site assessment and no other purpose. <br /> Upon execution hereof, Contractor shall pay Railroad the sum of Two-hundred and fifty Dollars <br /> ($250.00)partially to defray cost of handling. <br /> 2. Contractor and Sub-Contractor agree to: <br /> a. Perform that portion of the work on Railroad premises in accordance with plans and <br /> specifications approved by Railroad in such manner and at such times as shall not <br /> endanger or interfere with Railroad's operations and in accordance with the <br /> regulations of Railroad and instructions of Railroad's representative. Contractor or Sub- <br /> Contractor shall submit to Railroad for approval all construction details, falsework and other <br /> incidentals not detailed in plan, insofar as they affect the Railroad. <br /> b. Maintain,at Contractor's or Sub-Contractor's expense,competent flagman to protect and <br /> control movement of vehicles and equipment of Contractor or Sub-Contractor while on <br /> Railroad premises. <br /> c. Notify Railroad at least five(5)working days before commencing work on Railroad premises <br /> within five(5) working days alter such work is completed. <br /> d. Keep all equipment, tools and materials stored at last twenty(20)feet from the center line of <br /> of any operable track. Explosives or other highly flammable substances will not be stored on <br /> Railroad premises without the prior approval of Railroad's representative. <br /> e. Remove all of the Contractor's or Sub-Contractor's tools,equipment and materials from <br /> Railroad premises promptly upon completion of work, restoring Railroad premises to.the same <br /> state and condition as when Contractor or Sub-Contractor entered thereon. <br /> I <br /> Serving A"orthern California and the C'e'll al Vcl legs <br /> 1 <br />
