The permission herein given shall not be assigned by Contractor or Sub-Contractor without the prior consent of Railroad,except in the case of subcontractors who shall be deemed agents of Contractor subject to the terms of this agreement. 7. No vehicular crossing over Railroad's track shall be installed or used by Contractor or Sub- Contractor without prior permission of Railroad. 8, No work shall be done closer than twenty-five(25) feet from centerline of track between the hours of 0800 and 1000 , nor on Saturdays. Sundays,or legal Holidays without prior notification or percussion of Railroad. � 9. At request of Railroad, Contractor or Sub-Contractor shall remove from Railroad preituses any employee of Contractor or any Sub-Contractor who fails to conform to the instructions of Railroad's representative in connection with work on Railroad premises,and any right of Contractor or Sub- Contractor to enter upon Railroad premises shall be suspended until such request of the Railroad is met. Contractor and Sub-Contractor shall indemnify Railroad against any claim arising from the removal of ane such employee from Railroad premises. 10. Contractor or Sub-Contractor. at least five(5)days prior to performing any digging activities on the premises of Railroad, must insure and will be responsible for,contacting the proper and necessary agencies to determine if the work to be performed will involve any underground systems at the site. All relocation and/or protection of these systems will be the sole responsibility of the Contractor or Sub- contractor.
