Michael Oliphant - 2 - ` 20 November 2013 <br /> Tracy Rail Yard_Offsite East, Tracy <br /> Staff has the following comments: <br /> • Crude oil affected soil and groundwater has been addressed with respect to the historical TAOC <br /> crude oil pipelines, and additional characterization is not needed. <br /> • The residual TPH that remains in place at the Site is more than 40 years old, is immobile, and <br /> will degrade with time, likely over a period of years. <br /> • Based on submitted information, representations, and certifications of Chevron and AMEC, no <br /> further action at the Site is warranted and the case is considered closed. <br /> If existing, additional, or previously unidentified chemical constituents confirmed to be associated with <br /> the former crude oil pipelines and/or pump station at the Site, cause or threaten to cause pollution or <br /> nuisance, or are found to pose a threat to public health or water quality, then: 1) nothing in this <br /> determination is intended or shall be construed to limit or preclude the Central Valley Water Board or <br /> any other agency from taking enforcement action; and 2) this letter does not relieve Chevron of any <br /> responsibilities mandated under the California Health and Safety Code or the California Water Code. <br /> If you have any questions or comments, please contact Dean Hubbard at (559) 445-5179 or by email at <br /> dhubbard(c�waterboards.ca.gov. <br /> DANE S.
