Box 5004 <br /> San Ramon, CA 94583-0804 <br /> Dear Mr. Miller: <br /> UNDERGROUND STORAGE TANK CLEANUP FUND PROGRAM, FINAL STAFF DECISION TO REJECT <br /> CLAIM: CLAIM NUMBER 005791 <br /> I have received your request for a Final Staff Decision dated December 15, 1993. After review of the request and its <br /> supporting documents, I have decided to uphold the staff decision to reject the claim. <br /> Section 2811(a)(2) of the Petroleum Underground Storage Tank Cleanup Fund Regulations provides in part that the <br /> claimant must have obtained any permit required to own or operate the tanks pursuant to Section 25284 of the Health <br /> and Safety Code (H&SC) not later than January 1, 1990. <br /> The permit submitted to us was issued by San Joaquin County Air Pollution Control District for authority to construct <br /> three 12,000 gallon underground storage tanks served by a vapor recovery system and three dispensing systems served <br /> by a vapor recovery system. No evidence of a permit issued prior to January 1, 1990 by the local implementing agency <br /> to operate underground storage tanks was submitted. <br /> Please note that recent legislation (Assembly Bill 1061-Costa) allows the State Water Resources Control Board to waive <br /> the requirement that the claimant must have had the required permit to own or operate the tanks by January 1, 1990, <br /> as a condition for eligibility to the Fund for claims filed on or after January 1, 1994. However, one of the conditions <br /> for requesting the waiver is that the claimant was unaware of the permit requirement prior to January 1, 1990. It is <br /> difficult for me to accept the fact that Chevron was unaware of the permit requirement. An organization as large as <br /> Chevron, who is in the specific business of disbursing and marketing oil, would take reasonable and necessary steps to <br /> familiarize itself with the operating permit requirements as set forth by the local implementing agency responsible for <br /> issuance of the Section 25284 permits. <br /> If you do not agree with this Final Staff decision,you may request a review of the decision by the Chief of the Division <br /> within sixty(60) calendar days of receipt of this letter as provided in Article 5 of the Fund Regulations.
