The CITY OF STOCKTON, a municipal corporation in the County of San ° <br /> Joaquin, State of California, (hereinafter "CITY") grants a revocable permit to Chevron U.S.A. <br /> Products Company, a division of Chevron U.S.A. Inc., a Pennsylvania corporation, (hereinafter <br /> "CHEVRON") on property located in the City of Stockton, County of San Joaquin, State of <br /> California, commonly known as Swenson Park Golf Course, and more fully described as: <br /> A portion of property described as Assessor's Parcel Number 097-110-14 <br /> consisting of a groundwater monitoring well site located a minimum of thirty (30) <br /> feet west of the apron edge of green no. 12 as labeled MW-8 on the site plan <br /> Exhibit "A", attached and incorporated by this reference; <br /> (hereinafter the "Property") for the following purposes only: <br /> A. Construction, installation,maintenance, inspection operation,removal and <br /> proper abandonment of a groundwater monitoring well. The monitoring well shall be <br /> constructed substantially as shown in the typical monitoring well schematic as illustrated in <br /> Exhibit "B", attached and incorporated by this reference.. The well cover shall be installed no <br /> greater than one (1) inch above existing grade. <br /> B. Access to the well. CHEVRON shall provide a minimum of forty-eight <br /> (48)hours notice prior to intended access. Notice shall be given by calling CITY's Golf Course <br /> Maintenance Supervisor who will authorize access. <br /> 2. The license granted herein is revocable at the sole discretion of City upon a <br /> minimum of ninety (90) days notice. <br /> 3. CHEVRON agrees to indemnify,defend,and hold CITY harmless from any third 1 <br /> party liabilities, claims, damages, losses, or suits resulting from any investigation, monitoring v <br /> and/or clean-up activities conducted on the Property and including any enforcement action R, <br /> brought by any governmental agency. <br /> Page 1 <br />
