Sterling Drive, Suite 100 3120 Tracy Boulevard, Suite A <br /> Mountain House, CA 95391 Tracy, CA 95376 <br /> NOTICE OF VIOLATION AND REQUEST FOR A REPORT OF WASTE DISCHARGE, <br /> WATER TREATMENT PLANT WASTE DISCHARGE, MOUNTAIN HOUSE CSD AND <br /> TRIMARK COMMUNITIES, SAN JOAQUIN COUNTY <br /> On 5 June 2007 Regional Water Board staff met with representatives of Mountain House <br /> Community Service District (CSD), Shea Homes, and consultants to discuss the permitting <br /> status of the new drinking Water Treatment Plant (WTP) constructed at the Mountain House <br /> development. We discussed the fact that the discharge of waste from the existing WTP is not <br /> permitted by the Regional Water Board and is therefore a violation of the California Water <br /> Code (CWC). This Notice of Violation requires submittal of a complete Report of Waste <br /> Discharge (RWD). <br /> Staff has been working with Mountain House CSD to achieve compliance on this issue since <br /> March 2006, but to date no progress has been made. The previous communication regarding <br /> the need for Waste Discharge Requirements (WDRs) is summarized as follows: <br /> • On 20 March 2006 Regional Board staff performed an inspection of the existing WTP and <br /> informed the operators of the need to submit an RWD for the backwash water that is <br /> discharged to land. <br /> • The requirement for an RWD was reiterated in the Regional Water Board's 26 May 2006 <br /> Failure to Submit a Report of Waste Discharge correspondence (enclosed). <br /> • On 26 June 2006, Mike Buckley of Mountain House CSD contacted the Regional Water <br /> Board inquiring about the need for WDRs and was informed that WDRs are required (see <br /> enclosed Record of Communication). <br /> • In a 17 October 2006 meeting at the Regional Board office, staff informed Mountain House <br /> CSD of the need for WDRs and that groundwater data is required to perform the <br /> antidegradation analysis portion of the RWD. <br /> • In a 5 June 2007 meeting at the Regional Water Board office, your consultants proposed to <br /> submit an incomplete RWD, which would lack the necessary groundwater data. As stated <br /> in the meeting, that approach will not result in an expedited permitting process because the <br /> California Environmental Protection Agency <br /> C11, Recycled Paper <br /> CIWQS to 563886 <br />
