The wastewater discharge at Mountain House Community Services District is regulated by
two separate Waste Discharge Requirements (WDRs). WDRs Order No. 98-109 was issued for land
application of wastewater; WDRs Order No. 98-192 was issued for discharge to surface water.
Although it is unusual for the Regional Board to issue two permits for the same discharge, Mountain
House CSD and Trimark Communities requested and obtained the two permits. One result of having
two WDRs for the same discharge is duplicative monitoring requirements. However, you must comply
with all the requirements and monitoring schedules published in both orders. Both orders are
individually enforceable and failure to comply with either order may result in enforcement activity,
including imposition of Administrative Civil Liabilities.
Staff has determined that Mountain House Community Services District(CSD) and Trimark
Communities (Discharger) are not complying with WDRs Order No. 98-109. WDR Order No. 98-109,
Provision F.1 states:
The Discharger shall comply with the Monitoring and Reporting Program No. 98-109, which is
part of this Order, and any revisions thereto as ordered by the Executive Officer.
Wastewater has been discharged to the treatment system as indicated by a 20 December 2003 monitoring
report that stated wastewater was being treated and discharged in November 2003. The Discharger has
failed to submit monitoring reports as required by the Monitoring and Reporting Program (MRP) or has
submitted incomplete monitoring reports since at least January 2004, as follows:
1. No monthly self-monitoring reports were submitted from January 2004 to the present.
2. No annual self-monitoring reports were submitted for the years 2003 or 2004.
3. Condor Earth Technologies (Condor)prepared a 6 July 2004 Second Quarter monitoring report,
however it presented only data on groundwater monitoring and soil monitoring.
