The wastewater discharge at Mountain House Community Services District is regulated by <br /> two separate Waste Discharge Requirements (WDRs). WDRs Order No. 98-109 was issued for land <br /> application of wastewater; WDRs Order No. 98-192 was issued for discharge to surface water. <br /> Although it is unusual for the Regional Board to issue two permits for the same discharge, Mountain <br /> House CSD and Trimark Communities requested and obtained the two permits. One result of having <br /> two WDRs for the same discharge is duplicative monitoring requirements. However,you must comply <br /> with all the requirements and monitoring schedules published in both orders. Both orders are <br /> individually enforceable and failure to comply with either order may result in enforcement activity, <br /> including imposition of Administrative Civil Liabilities. <br /> Staff has determined that Mountain House Community Services District(CSD) and Trimark <br /> Communities (Discharger) are not complying with WDRs Order No. 98-109. WDR Order No. 98-109, <br /> Provision F.1 states: <br /> The Discharger shall comply with the Monitoring and Reporting Program No. 98-109, which is <br /> part of this Order, and any revisions thereto as ordered by the Executive Officer. <br /> Wastewater has been discharged to the treatment system as indicated by a 20 December 2003 monitoring <br /> report that stated wastewater was being treated and discharged in November 2003. The Discharger has <br /> failed to submit monitoring reports as required by the Monitoring and Reporting Program (MRP) or has <br /> submitted incomplete monitoring reports since at least January 2004, as follows: <br /> 1. No monthly self-monitoring reports were submitted from January 2004 to the present. <br /> 2. No annual self-monitoring reports were submitted for the years 2003 or 2004. <br /> 3. Condor Earth Technologies (Condor)prepared a 6 July 2004 Second Quarter monitoring report, <br /> however it presented only data on groundwater monitoring and soil monitoring.
