r <br /> CITY OF STOCKTON <br /> AZ# CERTIFIED MAIL <br /> RETURN RECEIPT <br /> DEPARTMENT OF MUNICIPAL UTILITIES Z 407 935 352 <br /> 2500 NAVY DRIVE <br /> STOCKTON, CA 952OB-1 191 <br /> (209)937-B750 <br /> FAX(205)937-B70B <br /> August 10, 2000 <br /> Mr. Mike McEver, Plant Manager <br /> Valley Tomato Products <br /> 760 Industrial Drive <br /> Stockton, CA 95206 <br /> NOTICE OF VIOLATION <br /> This Notice of Violation is intended to notify Valley Tomato Products of a violation of City <br /> Municipal Code Section 7-805 that occurred on July 27, 2000. <br /> Violation <br /> Section 7-805 prohibits the discharge, directly or indirectly, to the City storm drain system of <br /> any pollutant, wastewater, or any substance or material which will interfere with the <br /> operation and performance of the City's storm drain system or violate the City's NPDES <br /> permit. In this instance, the discharge was wastewater from tomato processing. <br /> Upon verbal notification on July 27, 2000, you accepted responsibility and agreed to <br /> commence cleanup efforts. Although your efforts to date have removed approximately 1 <br /> million gallons of wastewater from the storm drain system, the extended time for cleanup is <br /> unacceptable. The storm drain system and the Western Pacific Industrial Park Pump Station <br /> need to be put back online immediately. <br /> Therefore, the City of Stockton will be retaining a qualified environmental cleanup firm to <br /> complete the cleanup operations. As discussed and agreed to by you during an August 10, <br /> 2000 phone conversation with Mr. Bob Murdoch of this office, the costs incurred by the City <br /> for the cleanup will be your responsibility. <br /> If you have any questions regarding this matter, please contact Bob Murdoch at (209) 937- <br /> 8734. <br /> MORRIS L.
