To date the monitoring wells have not been <br /> destroyed and associated wastes have not been removed, in violation of Regional Water Board <br /> staff directives. The directives are necessary to achieve a final case closure determination. <br /> If we do not receive verification from SJCEHD that the monitoring wells have been properly <br /> destroyed with all associated waste removed by 1 February 2014, the case will be <br /> recommended for inclusion in the State Water Resources Control Board (State Water Board) <br /> Underground Storage Tank (UST) Cleanup Fund, Emergency, Abandoned and Recalcitrant <br /> (EAR) Program. The EAR Program is a special State Water Board UST Cleanup Fund program <br /> designed to contract with private environmental construction firms to conduct work at UST sites <br /> and recover the costs through subsequent placement of liens on the property.
